Term and Conditions

These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your subscription to the Bardwell Creative Inc. Newsletter Content Creation Service, including any related services (the “Service”) provided by Bardwell Creative Inc.



By subscribing to the Service, you are agreeing to be bound by these Terms and Conditions. If you disagree with any part of the terms then you may not access the Service.

The Service is protected by copyright, trademark and other applicable law. Nothing in these Terms gives you a right to use the Bardwell Creative Inc. name or any of our trademarks, logos, domain names or other distinctive brand features.

We reserve the right to refuse service to anyone for any reason at any time.

By subscribing to the Service, you agree that Bardwell Creative Inc. may contact you via email for promotional offers or other related information. You may opt out of receiving such emails at any time.

Subscription Payments

Subscription payments will be charged on a monthly or yearly basis. We may change the fees and charges in effect, but we will give you advance notice of these changes via email.

By subscribing to the Service, you agree to pay all applicable taxes or other fees. If a subscription payment is not received from you on time, or if Bardwell Creative Inc. is unable to process your transaction using the payment method provided, we reserve the right to cancel or suspend your subscription and terminate access to the Service.

Automatic Renewals

Your subscription to the Service will be automatically renewed at the end of each subscription period. You can choose to opt out of automatic renewal at any time.

These Terms and Conditions shall be governed in accordance with the laws of Massachusetts.

Your subscription to the Service includes these Terms and Conditions, our Privacy Policy, and any other agreements you may have with us. In the event of any conflict between these documents, the order of precedence shall be (1) Terms and Conditions; (2) Privacy Policy; and (3) Any other agreements.

If any portion of these Terms and Conditions is held to be invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

These Terms and Conditions, along with our Privacy Policy (the “Agreement”) constitute the entire agreement between you and Bardwell Creative Inc. regarding your use of the Service. This Agreement supersedes all prior agreements or understandings, whether written or oral. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, then the remaining provisions will remain in full force and effect.

We may assign any of our rights and obligations hereunder without your prior consent. You may not assign this Agreement without the prior written consent of Bardwell Creative Inc., which may be withheld in its sole discretion.

You agree to indemnify, defend and hold harmless Bardwell Creative Inc. and its officers, directors, employees, agents or representatives from and against any claims, damages or other losses arising out of your breach of this Agreement or use of the Service.

These Terms and Conditions shall be governed by the laws of the Commonwealth of Massachusetts without regard to conflicts of law principles. Any action or proceeding arising from or relating to these Terms and Conditions must be brought in a court located within Hampshire County, Massachusetts and you hereby consent to such exclusive jurisdiction and waive any objection to venue laid therein.
